WHEREAS the BUYER agrees to purchase and the SELLER agrees to sell to the BUYER the hereafter described dog upon terms and conditions stated in this agreement.
THEREFORE, it is mutually agreed upon between the SELLER and the BUYER as follows:

Seller’s representations:
The following representations and conditions which have been initiated by the SELLER and the BUYER apply to the sale of the aforementioned dog:

BUYER has 2 days to have dog examined by a veterinarian and personally inspect the dog. Any claims must be made in writing within this time period. BUYER is completely satisfied with and waivers any all claims regarding said dog’s conformation and outward appearance.
BUYER agrees pursuant to the purchase of dog that the dog will be registered under the kennel name of the SELLER.

The dog at the age of twelve months will not have developed any disqualifying show faults, according to the rules of the FCI, ADRK, USRC for this breed.

The dog at the age of twelve months will not have developed debilitating (crippling) hip dysphasia from natural causes rather than mistreatment by BUYER.

As the date of this agreement the dog is in good health and free of communicable deceases.
BUYER assumes full responsibility for the dog pertaining to injury or damage to person or property, once the dog leaves the SELLER’S premises.

In the event the BUYER decides to sell the aforementioned dog, the SELLER must be given first option of original purchase.

BUYER agrees to show the dog USRC-style conformation and also put USRC Championship on the dog.

BUYER agrees to show the dog in GERMAN-styles conformation shows, especially Regional and National events. If the BUYER cannot attend those show, SELLER will take the dog and will handle him/her at such events. BUYER agrees to reimburse SELLER for expenses (receipts must be available) spent on aforementioned dog.

BUYER agrees to put Schutzhund title or BH on the dog as well as the BST (Breed Suitability Test).

This dog will not be bred until he/she has passed it’s OFA.

Any ‘accidental’ breedings will NOT be registered with the AKC nor the USRC.

Only terms initiated by SELLER and BUYER are valid.

THE BUYER’S EXCLUSIVE REMEDIES REGARDING THE SELLER’S REPRESENTATIONS.

BUYER is encouraged to have the dog examined by a SELLER’S veterinarian at BUYER’S expense. Upon verification by the SELLERS veterinarian that the dog is in unsatisfying condition, the BUYER must notify the SELLER in writing and attach copy of veterinarian’s exam. Letter must be certified and postmarked within time period mentioned above. Upon abovementioned verification the BUYER has following options:

Option must be chosen at the time of purchase (initial one)

A). Return the dog for a full refund, or BUYER____________
B). Replace the dog with another one of equal value. BUYER_______________

Amount and payment of purchase price.

The purchase price for the dog described in paragraph 1. shall be

The purchase price shall be paid as follows:

a). $___________paid in full to the SELLER upon execution of this agreement.


b). $___________paid to the SELLER upon execution of this agreement. _____ equal monthly installments of $_____________each, commencing on the first day of every month thereafter, until paid in full.

If installment is not received by SELLER by third day of every month, the SELLER shall recover the dog, all agreements made between SELLER and BUYER shall be terminated and BUYER shall be hold responsible for all expenses spent by SELLER for dog recovery (BUYER_____________).

If the form of payment presented by BUYER is any other than cash, the SELLER has right to request a photocopy of BUYER’S I.D. card. Returned checks are subject to $35.00 fee and all other fees and expenses caused by invalidity of the check (BUYER___________).

SELLER reserve the right to hold the dog on his/her premises until the presented form of full payment/down payment is cleared by the bank.

If form of payment presented by BUYER is a fraud, SELLER shall contact authorities immediately.

Death, loss or destruction of the dog from any cause whatsoever, before the final payment has been received, shall not release the BUYER from further payments.

Registration and Pedigree Papers.

The title of ownership and the right of registration in the dog sold under this agreement shall remain in SELLER’S or it’s assign’s until full payments has been made by the BUYER and received by the SELLER. Pedigree papers and signed registration application will not be delivered by the SELLER to the BUYER until all payments has been made.
Venue, Applicable law and attorney fees.

This agreement mutually stipulated to have been entered into __________________county, state_____ regardless where it is signed. The BUYER and the SELLER agree that the proper venue for any legal action taken to enforce terms and conditions of this agreement shall lie in________________, state___ and that this agreement shall be interpreted in accordance with the laws of the state of _________.

In the event legal action is taken, the prevailing party shall be entitled to an award of attorney fees and costs.

Transferability.

This agreement is limited between SELLER and BUYER. It is not transferable to a third party.

Subsequent Expenditures.

SELLER’S maximum responsibility is limited to the purchase price of the dog. Any subsequent expenditures are the sole responsibility of the BUYER.
Any other agreements are invalid unless stated in writing in this agreement.

VON KOZAK ROTTWEILERS general kennel dog release terms:
The BUYER agrees to provide the dog with all necessary vaccinations and medications (if needed).
The BUYER also agrees to provide socialization for the dog. The BUYER agrees not to abuse the dog, provide him/her shelter, proper food and drinkable water.
The BUYER agrees to allow the SELLER to visit BUYER’S property for evaluation for dog’s suitability.
The BUYER agrees to transfer the above mentioned dog to the SELLER with NO REFUND if BUYER shall keep the dog in conditions unsatisfied by local laws.
The BUYER shall not train the dog for aggression against people (only bite work is allowed under supervision of professional dog trainer, must obtain license# and address), dog fights or any other trainings not permitted by law.
The BUYER shall provide necessary fencing and security for the dog. If no such property is available, the BUYER shall keep dog on leash in all public places except where allowed by law.
The BUYER SHALL NOT leave the dog unattended or allow children to play with the dog without parental supervision at any time.
The BUYER understands that ROTTWEILER is a large and powerful breed; therefore the BUYER shall provide substantial force to handle the dog.
The BUYER shall provide sighs that state that there is the dog on the property.
The BUYER shall inform himself/herself with as much information as possible to provide the best conditions for the dog (information can be obtained through breeder, veterinarian, local pet store or through information available in internet or literature, dedicated to this breed).
